McConnell does seem like the type of Senator who would spend his time on his deathbed trying to make sure his successor gets the seat.

In regards to the law change this is basically an arms race that is going to happen more & more; Governor appointments are a hangover from a bygone era & it's going to take the senate flipping as a result of one to finally push every state to do this.
