There are real questions as to if she was undercover at the time of the Novack column, but my understanding of the statute was if she had been undercover within the past five years and assigned outside of the country.
There is a real question if she is covered by the act, though I have not seen evidence either way.
I cannot, at this point, state that a crime was committed, except the theoretical contempt by Miller.
