Yes, but what if the Supreme Court is on the opposite side of both the people and the Constitution? Even though having the death penalty for child rapists is an nonsensical policy IMHO, they had no constitutional authority to overturn it at the state level.

Uhm...the 14th amendment coupled with the 8th. I might be able to entertain an argument it's not cruel and unusual, but the 14th amendment certainly gives them every right to consider punishments of state criminal courts.
