She's not ineligible. New York just can't cast it's electoral votes for both Gillibrand and Clinton. Still, it seems unlikely.

Apparently none of the patrons or staff in the restaurant recognized her. She was wearing dark sunglasses though, so I imagine she was trying to go relatively incognito. She probably doesn't want to get mobbed and have news helicopters zooming overhead.
