From what I hear, immediate review before trial is rare. But it's good news for Trump & the others. The Appeals court could agree to take the case, and after review, they might agree to kick Fani off the case.  At the very least, trial won't be scheduled for a bit until the appeals court either refuses to take the case or rejects the motion

I don’t think she’s going to be kicked off the case if she wasn’t by McAfee. What it does do is delay.

If I lived in Fulton County I'd probably vote for McAfee unless he does something crazy before election day, because if he was removed and a new one took over there's no guarantee that new one would be a Democrat or not a more partisan Republican. It's not like it would automatically go to his challenger.

It seemingly would, per the preceding post. And now, McAfee only has the one challenger, who's the former executive director of the Rainbow PUSH Coalition.

So, let's talk about the Georgia Court of Appeals. Now that Judge McAfee has granted the certificate of immediate review for the disqualification of Fani Willis, what's the process? The application for an interlocutory appeal will be randomly assigned to a judge. From there, it will be assigned to a staff attorney who will review the application and any supporting materials. That attorney will provide a memo providing a recommendation to the judge on whether the appeal should be granted or denied. The court has 45 days to act, so decisions are quick.‬

‪Court of Appeals Rule 30(a) provides factors that favor review. The most important one here will be whether there is a need to establish clear precedent to refine and guide the trial court. Defendants will have to argue that precedent is insufficient *and* this is a good vehicle.‬

‪The other key is this: is there *reversible error*? Even if there might be a need for some clarification around the law, the COA may not necessarily see the need to step in and reverse Judge McAfee if they think he essentially got it right. That may be the biggest hurdle for D[efendant]s.‬

‪Appeals are heard by a three-judge panel. Only one judge on a panel needs to agree to hear the appeal. All three are thus required to agree to deny it.‬

Of all of Trump's 100 ongoing legal entanglements, this one turned out to be the biggest flop. And it was avoidable if Fani had just acted properly

Why do you think Larry Craig Downlow gay sex sting was in news he went after and impeachment of Bill Clinton

Also the J6 Rs made Gore concede prematurely before the votes were counted and lost by 500 and Trump lost by more than 500 votes and wanted every last recount, that's why Trump polls are crashing

The biggest mistake Fani made, even moreso than her ethical shortcomings, was making this a RICO case. It was already a stretch to apply RICO to this, but it's a far "sexier" charge than something like extortion or fraud. Anyone who knows anything about RICO cases will tell you that they take FOREVER due to all the moving parts involved. It was foolish for anyone to think that this case would conclude before the election

Not really.  The 1/6 one could still happen before the election depending on what the Supreme Court does as could this one.  The only one that definitely won’t happen before then is the Classified Documents case.

I will be shocked if the corrupt Roberts Court puts justice and America over Donald Trump and the Republican Party.
