Michael Mukasey can explain the legal argument better than I can.

I will say this, personally:  I can think of no other major political figures outside of Bill and Hillary Clinton that do a worse job of avoiding the appearance of impropriety in just about everything.

I have little doubt that she lied to the FBI and to Congress.  I have little doubt that she deliberately mishandled classified information.  These matters are, indeed, crimes.  The laws governing classified information are what they are for good reasons.

If the e-mail matter were the only blot on Hillary's public record, most folks would give her some slack.  But the revelations of how things are bigger than she said they were bring a "This, again?" response from lots of folks, including folks who aren't real political.

The Clintons can't appear to be above question because they're not.  They don't really try to appear that way; they rely on parsing words and lawyer-ese to muddy waters.  What they've done during Hillary's 2016 campaign isn't the first time.

Trump is Trump is Trump, but he was elected in competitive primaries.  Hillary, however, had the deck cleared for her by the DNC; it took a non-Democrat Socialist who was an outlier to provide a credible challenge to Clinton's nomination.  The Democratic Party cleared the decks for a sleazebag.  Since Bill will come back as the First Gentleman, that will make it two (2) sleazebags.  When a party can nominate a candidate with basic integrity and blocks that for Clinton Redux, what does it say to John Q. Public?
