In my youth, I was a Democrat. I supported John and Bobby Kennedy, and I even voted for George McGovern in 1972. I proudly voted for these great men and I'll openly admit that I supported the Democratic Party of the 1960s and 1970s. That's not something I'm ashamed of. What I am ashamed of is what the Democratic Party has become. Even as early as 1975, I saw it coming - A wave of super-leftist liberalism that left no room for the middle-of-the-road people like myself. This isn't the party we want in charge of the White House. If they can't compromise with themselves, how can they compromise with the Republicans? The Republican Party is truly a big tent party that welcomes members from all ideological sections of life. Round XXVII: September 19-27

The First Presidential Debate scheduled for September 30th at the University of Miami is twelve days away. All four major candidates are expected to attend. The General Election has seen the campaign heating up between all the candidates. Senator and VP Nominee Kay Bailey Hutchison took to the stump attacking Joe Biden for his recent comments on Rudy Giuliani's past indiscretions. Even Congressman Kucinch expressed disappointment in Biden's attack. Speaking of the Ohio Congressman, his poll numbers have been steadily rising and he currently leads in the state of Vermont, the home state of his running mate Bernie Sanders.

On the stump Gary Johnson has been appearing more and more enthused and passionate, telling his supporters at a recent rally, “Lets prove that it’s the American People that decide this race, not big money! We need someone who will work for the American people! No more establishment career politicians and lobbyists! We don’t need someone who owes political favors! We need leadership, and someone that will fight for your rights!” Johnson's poll numbers are also on the uptick, which bodes well for his campaign ahead of the first debate.

Joe Biden has drawn new contrasts with Giuliani, playing up the economy and pitching an economic populist message, focusing on the minimum wage and pocketbook issues. Biden seems to be focusing in the key battleground states of Ohio, Pennsylvania and Florida, while also playing to Arizona, Nevada, Montana and North Carolina, not typically Democratic friendly states. In contrast to Giuliani who is still running on his fifty state strategy, it appears the Democrat's best option to play defensive in the Gore states and offense in the battlegrounds and Republican states from Bush.

Rudy Giuliani has been targeting much of the midwest, as well as the pivotal battleground state of Florida. Giuliani is also running ads across the country, focusing on many of the key states including Ohio, Minnesota, Wisconsin and New York. Giuliani continues to play up the important themes of security, while touting his plans for the economy. Some pundits still give Giuliani the advantage in the election, but Biden continues to play a strong efforts, which making many to call this election a pure tossup!

Polls show an increasingly tight race between Giuliani and Biden, recent polls give Giuliani on average at best a one to two point lead over Biden. This year unlike many past elections the debates are shaping up to be a critical turning point for the campaign!

D.C. Police Inmate Dies in Jail Cell

Sept. 21, 2004 - Jonathan Magbie, a 27 year-old disabled man, died yesterday in a D.C. jail cell. Magbie was arrested last week for possession of a small amount of marijuana, which he used for medicinal purposes.

See, Magbie is disabled. He cannot function without the help of a parent or friend, neither of which he found on the fourth day of his ten-day jail sentence.

Judge Judith Retchin of the D.C. Supreme Court, was warned of the inevitable health affects of Magbie's jail sentence. Magbie, a first time offender, possessed the small amount of marijuana because it provides the medical benefits of prescription medication, but without the side effects that can be insurmountably worse for a disabled person. Retchin sentenced Magbie to a 10 day sentence anyway.

After being sent back to jail by an incompetent doctor, Magbie's condition worsened on the fourth day of his sentence. Slowly he began to intake more carbon dioxide, and his heart gave out.

Magbie's condition as a quadriplegic required up to 20 hours a day of private nursing care. The city was informed of this during the trial, as was Judge Retchin before deciding on her 10 day sentence.

Magbie is survived by his mother. She has not made a public statement at this time.

BIDEN: Good evening. The mother of Jonathan, Ms. Mary Scott, will begin by making a statement.

SCOTT: Hello. My son was a good man. He loved family, and friends. When Jon was four years old, we were hit by a drunk driver. He was paralyzed from the neck down ever sense. Jon handled his challenges with so much courage. He requires a ventilator. He requires a- required a ventilator to function. The D.C. police and court that arrested and sentenced him knew everything, and did nothing. My Jon died on the fourth day, just like he told them he would. All because he had some medicine. Yes, pot. I said it. I ask for your prayers and support, and support for everyone who uses medical marijuana because of the few side effects.

BIDEN: Today Ms. Scott and the ACLU have asked me to announce that they will be bringing suit, against the District of Columbia government, and Greater Southeast Community Hospital, where Jon received inadequate care and was sent back to jail only to die hours later.

This tragedy is also cause for us to reflect. Too many politicians, some even in this Presidential race, are too cowardly to tell the truth about the colossal failure that has been the War on Drugs. We have to have strong and strict regulations against controlled substances. We can not have an unjust jail system or harsh mandatory minimums that appear tough on crime, but are in fact ineffectual. Jonathan Magbie was but one recent, and public casualty of this War on Drugs that has been augmented by the Bush/Giuliani Administration.

I am not calling for a big federal law. I'm calling for a big national conversation. We should be honest with ourselves, should we not? We should be honest that our police officers can root out gangs and cartels or they can root out sick young men or women who take medical marijuana to get by with their disease. We should be honest that too many turn a blind eye to teenagers smoking cigarettes and drinking, but those same people step on the soapbox when it comes to medical marijuana. We -have- to be honest that jail should be for serious crimes, a principle I have always fought for.

I have long said that this campaign is for the people. There is a moderate majority here in America, often too silent, but this year they need to speak up. Too often the moderate majority is left out of the conversation in Washington. Too often the fringes of the debate become the decision-makers and compromise becomes a toxic walk-of-the-plank. I have spent my entire career fighting for those very people, making sure they have a seat at the table and a voice in the debate. I am calling on this country to shake itself off and step forward, together. God bless you, and this country, good night.

Today at ACLU headquarters in D.C., Senator Biden denounced the death of a first time offender, arrested last week for possession of a small amount of medical marijuana. What follows for the press is general information about Mr. Magbie, his condition, and what happened to him.

JONATHAN MAGBIE – BORN 1977.
MAGBIE was paralyzed from the neck down after being struck by a drunk driver at the age of four. (1981-1982)

He was charged with medical marijuana possession after police found the medicine in a vehicle in which he was stopped.

MAGBIE has never been convicted of a criminal offense. He is a quadriplegic, and requires private nursing care for up to 20 hours a day.

D.C. Superior Court Judge Judith Retchin sentenced MAGBIE to a 10-day jail sentence in D.C. For possession medicine he uses to manage his condition.

On the fourth day of his jail sentence, MAGBIE's condition worsened and he was sent to Greater Southeast Community Hospital, where he received inadequate care that did not stop his worsening condition. Upon re-arrival in his jail cell, his lungs took in more carbon dioxide than oxygen and his heart gave out.

"I'm not saying that he shouldn't have been punished, because he did smoke the marijuana," his mother, Mary Scott, said yesterday, a day after burying her son. "I just don't think it should have cost him his life."

By the standards of D.C. Superior Court, the 10-day sentence rendered by Judge Judith E. Retchin was unusually punitive for a first-time offender such as Magbie. Along with his defense attorney, Boniface Cobbina, a pre-sentence report had recommended probation, and the U.S. attorney's office had not objected.

Even the Correctional Treatment Facility, a jail annex that houses many inmates with medical or security needs, would not have been able to readily care for a prisoner such as Magbie, Philip Fornaci, executive director of the D.C. Prisoners' Legal Services Project, said yesterday.
"I certainly would not say they killed him or any conclusion like that," Fornaci said. "But it certainly seems likely that he wouldn't have died if he hadn't gone to jail."
