Your Honor, ladies and gentlemen of the jury,

I will return to my opening statement. To be guilty of voter fraud, one must register an account that is not one's primary identity.

Did my client register an account other than Giovanni? Yes, nobody is disputing that.

The difference in this case to other trials for voter fraud is that my client had no access to his primary account, meaning that no primary identity existed at the time of his second registration.

You may tend to agree with the prosecution's statement that my client acted in a weird...or even unethical manner. I understand that, and I don't condone my client's behavior...that he neglected to state that he was actually Giovanni.

But the fact remains that that is not relevant. If you vote to convict my client, you are effectively saying that people in his situation, through a simple typo while entering his e-mail address, are not allowed to vote until that person's name is removed from the voter roll. My client would have been denied his right to vote. I find that unacceptable.

Yes, Dave can merge accounts together, and he did in this case, but when my client registered that second account to vote, that account was inaccessible.

This case is very different from any accusation in the past of voter fraud in Atlasia, and please do not feel that you are required to convict my client to remain impartial. This case as a very different background, and the decision here is not between being compassionate or doing your duty to convict a criminal.

Quite the contrary, I request that you think about the term "primary identity". I believe that an objective interpretation of "primary identity" is that the accused person must actually be able to use that account to vote! If that condition isn't there, for all intents and purposes, no primary identity exists any more in Atlasia.


Please do the right thing, and find Giovanni not guilty of voter fraud.

The facts are clear and undeniable. At 4:07 PM EST on December 15th 2009, Giovanni, under the account "Farmer-Labour," registered a second account in Atlasia. This is clearly a crime under Section 1, Clause 3 of the Consolidated Criminal Justice Act.

The defense has rested their entire case on the fact that Giovanni could not access his original account. The defense is attempting to cleverly world their statements to allow a guilty man go free, switching from the terms “primary account” and “primary identity” within a sentence.

But the defendant didn’t tell us that he could not access his main account. He didn’t create a second account named something like “Giovanni 2” explaining why he had to make a new account. Surely we would have understood his situation. He could have confirmed that he was in fact Giovanni via other methods, such as instant messenger or e-mail if there was any doubt concerning whether or not he was in fact the real Giovanni. He could have gone into the registration thread and asked what the appropriate course of action would be, and likely would have been allowed to register a second account as long as it was clear that he would be updating the registration of the Giovanni identity. I certainly would not have prosecuted him for this and I don’t think any jury would convict him for it.

Instead, he deceived us and created the Farmer-Labour identity. He not only registered a second account, but a second identity and yes that is relevant. By not telling us he was Giovanni, he acted in a way that made two of his identity's accounts registered simultaneously. Josh/Devilman88 registered a second account & identity and was found guilty. It would be unjust to find one defendant guilty and another innocent for what is a similar crime.

This trial concerns one of the most important laws in Atlasia and it is critical that it be upheld. Even the defendant himself has said he should be punished.
