It's a shame the death penalty didn't stay banned after SCOTUS ruled it unconstitutional in 1972
Except it never did that. What it ruled was that all existing death penalty statutes were unconstitutional, not that the death penalty itself was. Given that the fifth amendment itself implicitly accepts that capital punishment is constitutional, I can't see any court ever ruling that capital punishment per second is unconstitutional.
