The problem with saying that there is no harm done to people in the present is twofold:
1) Yes, there certainly is harm being done in the present, though often more subtly and less overtly than in the past.
2) The specific harms done have tended to reverberate through generations. Wealth accumulates wealth, and if as a class African Americans have been prevented from accumulating wealth through discriminatory housing policy, discriminatory policing and sentencing, explicitly discriminatory laws, etc., then just abolishing those laws doesn't bring the people who would have been affected by them up to parity with everyone else.
People living in poverty have a lot harder time pulling themselves up than people not living in poverty. Because of discriminatory policy in place for hundreds of years, African Americans as a group have massive disproportionate levels of poverty. Those levels today are directly linked to those policies, even if they're not in effect anymore.
