What I don’t understand is what happens if a girl was molested by her stepdad and how passing abortion control on 16 year olds just feels like passing abortion control on rape victims. Shouldn’t these types of situations be exceptions in abortion bans or abortion control? Why didn’t they do something like spousal consent? It could now probably be passed... And spousal consent would allow a direct challenge to C vs PP AND be more inline with the anti abortion movement as it has changed under Trump.

These laws all have some sort of arrangement for a judicial bypass in cases of rape or abuse that either waves the requirement or allows another responsible adult to fulfill the parental role.

You mean that a kid needs either parental consent or a lawyer?

One would expect a clinic would have the capability of getting in touch with a judge.

You mean they would have their own staff GAL? They don't practice law.

No they would go through social services.  They are supposed to report cases of child abuse anyway, even though they often don't.

I could perhaps be moved to accept a consent law IF its oriented around that thinking. I would totally be OK if this law was designed to help with the report of child abuse though I don't know how the notification law wasn't sufficient.

Attorneys frequently act as Guardians ad litem, and get appointed by the courts to do that job.

Texas to allow abortions amid pandemic after court fight
Quote
The state in a filing late on Wednesday told a federal judge in Austin, Texas, that a new executive order by Republican Governor Greg Abbott regarding elective medical procedures provided exemptions that would allow abortions to not be postponed.

The order allows healthcare facilities to resume elective medical procedures if they agree to reserve hospital capacity for COVID-19 patients and not request personal protective equipment from public sources during the coronavirus crisis.

Texas Attorney General Ken Paxton’s office said because the abortion providers challenging an earlier, stricter order by Abbott that expired on Tuesday have certified their compliance with the exemptions, there “is no case or controversy remaining.”
