Google is racist Act

1. As used in this act:

A. racist robot means any artificial intelligence or algorithim that is programmed, designed, or intended to perform any function or task in a manner that intentionally discriminates on the basis of race, skin color, or ethnicity. For purposes of this act, a function or task includes but is not limited to providing search engine results, generating images, promoting information, and answering questions. For purposes of this act, intentionally discriminates includes but is not limited to any program intended to promote or discourage diversity, inclusion, or equity (DIE) of purportedly "underrepresented" races, skin colors, or ethnicities.

B. Historically-illiterate robot means any artificial intelligence or algorithim that is programmed, designed, or intended to perform any function or task in a manner that intentionally provides historically incorrect data or responses. For purposes of this act, a function or task includes but is not limited to providing search engine results, generating images, promoting information, and answering questions. For purposes of this act, intentionally providing historically incorrect data or responses includes but is not limited to any program intended to promote or discourage diversity, inclusion, or equity (DIE) of purportedly "underrepresented" races, skin colors, ethnicities, sexes, or other identity group or belief.

2. It shall be a felony punishable by imprisonment for no less than three (3) years and no more than twenty (20) years and a fine of no less than $10,000.00 and no more than $250,000.00 for any person in Atlasia to knowingly import, sell, rent, or transfer, advertise for sale, rental, or transfer, manufacture for sale, rental, or transfer, transport for the purpose of selling, renting, or transferring, or finance the sale, rental, or transfer, of any racist robot or historically-illiterate robot. For purposes of this act, uploading or transmitting a program or code that enables a device to download the artificial intelligence to program a racist robot or historically-illiterate robot or a 3D printer to manufacture a racist robot or historically-illiterate robot, or the components thereof constitutes a transfer in violation of this provision.

3. This act shall take effect immediately.

This bans racist and intentionally historically inaccurate robots.  This should have zero negative impact and only affect big tech oligarchs attempting to rule us as slaves with a racist droid army.

I find very little to agree with the sponsor on these days, but this appears unobjectionable and I will support it.

Can the author define "diversity, inclusion, or equity (DIE) of purportedly 'underrepresented' races, skin colors, or ethnicities"? Without a clear definition, it seems like this legislation could potentially criminalize the mere "inclusion" of "purportedly 'underrepresented'" groups in search results. Thus, if I tried to search up "Native Hawaiians" and the search results "included" pictures of Native Hawaiians it would send some Google developer to jail for twenty years, which I'm sure is not what the author intends.

The scenario you present is not at all possible under the existing definition text. A racist robot isnt a robot that "includes" purportedly underrepresented groups, it is a robot that is programmed or designed to "promote or discourage" (i.e. intentionally modify results to achieve a specific, non-viewpoint neutral bias) DIE. If you search for images of native Hawaiians and the robot responds to the request by neutrally producing images of native Hawaiians, that would not be a racist robot under the existing definition. The operative terms are "promote or discourage" as these programs are intentionally written to acheive a result other than one of neutral accuracy or responsiveness. Even a search request specifically for "black Nazi" or "female pope" would not result in an otherwise neutral program becoming a racist robot as the robot is not being "programmed, designed, or intended" to independently "promote or discourage" anything other than responsive or accurate results.

Without an actual definition for what "diversity, inclusion, and equity" programs actually entail it is left completely up to interpretation. What does promoting or discouraging such a program mean? Who decides what does or doesn't count as that? Why not just ban historical inaccuracy itself (if that is what you're concerned about) rather than defining historical inaccuracy as promoting diversity, equity and inclusion?
